Terms of agreements (Ts & Cs)

These terms and conditions explain your rights and responsibilities and also mine.

“You” means the Client named in the Contract, “I” and “Photographer”/"Videographer" means Josh Holgate Photography.

The “Contract” means the contract accepted by you in submitting the Booking Form, and incorporates these terms and conditions.

“Wedding” shall, if the context so requires, be deemed to be a reference to a civil partnership ceremony or any other analogous ceremony.

  1. General
    I agree to supply to you wedding photography/videography services in accordance with the Contract. The Contract incorporates all the terms agreed between us and no variation shall apply unless agreed in writing and signed by both parties.
     

  2. Payments
    The Booking Fee is payable by you on submitting the Contract. This will be set against the total fees payable by you and is non-refundable.

    The Balance of the Package Fee must be paid by you no less than 30 days prior to the date of the wedding. If the Package Fee is not paid by that date, I reserve the right not to provide any services until payment is made or to treat the Contract as being cancelled by you. The provisions of clause 9 will then apply.
     

  3. Coverage / Special Requests
    I will discuss with you your general requirements and wishes in relation to the taking of the photographs/video.

    I ask you to note any extra requirements agreed (beyond the standard package) in the space on the Contract provided for that purpose. 

    You should be aware that in some cases, it may not be possible for these to be followed due to factors such as weather conditions, lighting conditions, cooperation of the subjects being photographed/filmed and time constraints. You, therefore, grant me full and unfettered artistic licence in relation to the content of the photographs, their arrangement, composition and location.

    You assume responsibility for obtaining any necessary permission, clearance permits, etc., which may be required for the Photographer/Videographer to photograph/video each event, public or private. You also assumes responsibility for obtaining and retaining permission for access to any requested camera positions. You warrant that you have the legal rights to anything Josh Holgate will video/photograph including photos or musical recordings.

    Photographs/video will be taken against the available backgrounds. Please note that moving objects or performing other cosmetic duties on location is not part of my service.
     

  4. Travel
    Travel within Hampshire (and reasonable journey's between key locations) is free. Outside of this, a standard mileage charge of 45p per mile applies. 
     

  5. Additional Services
    Unless otherwise agreed in writing a separate fee will be charged for all additional services ordered (post contract), in accordance with my current price list. The price of any additional services must be paid in full before delivery.  

    If the Photographer/Videographer is requested to stay for a longer period at the wedding or reception we will try to accommodate all reasonable requests but can not guarantee that they will be able to do so. I reserve the right to charge additional time as an additional service at the rate specified on my current price list, a copy of which will be provided upon request.
     

  6. Copyright
    Upon receiving your wedding photographs, you also receive Usage Rights to accompany them. Specifically, you receive a Personal licence to use your images for Personal Use - for example printing for personal display, using them on your social media, giving copies to friends and family for their personal use and display, and creating your own personal products (prints, calendars, photo books, albums). There is no time or geographic limit on this Personal licence. Your licence precludes Commercial use. Examples of commercial usage include but are not limited to; uploading to a stock image library, syndicating (re-selling), publishing in print and online media or promoting a commercial enterprise. The copyright in all images and copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer file or printed documentation relating to such images remains our property, but you have a licence to use them for Personal, non-commercial use. If, at any stage, you are unsure as to whether a use you are putting your images to is considered commercial, you agree to contact me to check your rights.

    I reserve the right to use or display any images/videos created as part of this Contract as part of my portfolio, at exhibitions, or for marketing purposes including my website and social media channels.
     

  7. Colour
    Every effort will be made to provide a good colour balance between photographs/videos but this may not always be possible due to factors such as lighting conditions and digital sensor limitations. Prints made on different occasions or in different sizes may also vary. Accordingly, no warranty is given that an exact colour match can be provided.
     

  8. Archive Images/Video
    Images/Videos from the event will be available online for at least 3 month's following the date of delivery at no extra cost to the client.  The Photographer/Videographer will not however be liable for any disruption that may result from the unavailability of web services.  

    I cannot guarantee to secure copies of the images/videos forever; I will keep a copy of the deliverables for a minimum of 1 year after delivery. You are advised to make a back-up of the digital files you receive from me to protect yourselves in the event of loss, digital corruption or theft.
     

  9. Cancellation
    You may cancel the Contract at any time by notice in writing. You will then be liable to pay compensation based on a percentage of the Package Fee depending upon when the notice is received:

    121 days or more – booking fee only
    91 – 120 days – 50%
    61 – 90 days – 60%
    31 – 60 days – 75%
    0 – 30 days – 100%

    If the photographer is forced to cancel the agreement then any fees will be reimbursed in full to the client.
     

  10. Postponing
    If the date of the wedding is postponed, I may at my sole discretion (which I will exercise reasonably having regard to my ability to obtain alternative work on the first agreed date and availability on the second date) agree not to treat the Contract as being cancelled but to provide the services on the postponed date and apply all monies paid by you towards the fees for that day.
     

  11. The Photographer / Videographer
    In the unlikely event that I am unable to attend for reasons beyond my control (e.g. death, injury or illness) I will use my best endeavours to arrange a suitable replacement. If this is not possible clause 12 shall apply.
     

  12. Force Majeure
    The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.  If the photographer cannot perform this agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to photographers illness, then the photographer shall return the deposit and fees paid in full to the client but shall have no further liability with respect to the agreement. This limitation on liability shall also apply in the event that photographic materials are damaged or lost through camera or equipment malfunction, lost in the post, or otherwise lost or damaged without fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the clients order.
     

  13. Safety
    The photographer reserves to right to terminate coverage and leave the location of the event if they experience inappropriate, threatening, hostile or offensive behaviour from person(s) at the event or in the event that the safety of the Photographer is in question.

    You agree to be responsible for any injury, loss or damage caused to the photographer/videographer or equipment caused by your guests.

    I will exercise the reasonable skill care and judgment that you would expect of a professional photographer but I shall not be liable for events beyond my reasonable control nor for loss which is indirect or consequential.
